The Federal government is, by far, the largest contractor in the U.S. and awards contracts for various products and services such as electronics, office supplies and furniture, vehicles, food and beverages, tools and equipment, construction materials and services, architectural and engineering services, maintenance and repair, financial services, risk management and technology consulting services, just to name a few. Countless goods and services are also subcontracted by government contractors to other businesses. The Federal Acquisition Regulation (FAR) governs procurement by federal government executive agencies. The FAR authorizes federal government agencies to issue or authorize the issuance of agency-specific regulations that implement or supplement the FAR.

Contracting with the government is dramatically different than commercial contracting with the private sector. Driven by public policy and U.S. law federal government contracts are heavily regulated to curb misappropriation of funds and ensure uniform policies and practices across agencies. Contract terms are the product of careful drafting by teams of government attorneys and have often received distinct meaning through past contract adjudications. Given the government's special status, disputes under federal government contracts follow a different procedural path than those under private contracts.

Among the federal agencies, the Defense Department (DoD) is the largest government purchasing agency, buying products such as aircraft components and accessories, electronic components, instruments and laboratory equipment, and vehicular equipment. The Department of Defense 2009 procurement budget was approximately $104.2 billion. The U.S. General Services Administration (GSA) is another large agency that makes purchases totaling approximately $66 billion a year.

State agencies, municipalities and public authorities operating under state law are subject to similar government contract regulations but at the state level.
